A 37-year-old British man appeared before the Paphos District Court on Monday morning, who faces a charge of causing the death of his three-year-old son through a reckless, careless, or dangerous act.
The case was scheduled for today for sentencing arguments and mitigation of the sentence. However, the proceedings did not proceed, as the 37-year-old’s defense attorney, Alexander Alexandrou, requested an adjournment until tomorrow, Tuesday, in order to allow for the submission of additional documents to accompany the written motion for mitigation.
As Mr. Alexandrou stated, the defense intends to submit a written plea to the Court, setting forth factors and reasons which, as will be argued, should be taken into account so that the Court may show leniency and impose the minimum prescribed sentence on the defendant.
To support the arguments set forth in the written brief, the defense wishes to submit a series of documents and other relevant evidence.
According to the defense attorney, due to the time difference with Great Britain, as well as the weekend, it was not possible to obtain in time a document from the 37-year-old’s workplace regarding his professional competence and other related matters.
Consequently, a request was made to adjourn the case for one day so that the specific document could be produced and included in the materials supporting the defense’s written argument.
The Court accepted the request, and the representative of the prosecution, Chrysou Perganti, raised no objection. The case has been rescheduled for tomorrow, Tuesday, at 10:30 a.m.
During Tuesday’s proceedings, the representative of the prosecution, Chrysou Perganti, is expected to first present the facts of the case orally before the Court. Subsequently, the defense attorney is expected to submit a written plea for leniency, which will include the relevant facts and arguments, and will then present it orally before the court.
The 37-year-old has already pleaded guilty to the charge he faces, which concerns causing the death of his three-year-old son due to a reckless, careless, or dangerous act.
The case concerns the death of the three-year-old boy, who lost his life after falling from a height of approximately 10 meters from the fourth floor of a hotel in Paphos, on the first day of the family’s vacation in Cyprus.
The court has ruled that the defendant remain free under the same conditions.
