The Court of Appeals upheld the detention of a 26-year-old man for importing and possessing opium poppies

The Court of Appeals rejected the appeal of a 26-year-old man who sought to overturn the order for his detention pending the start of his trial before the Criminal Court, in a case involving charges of importing, possessing, and possessing with intent to supply a Class A controlled substance, specifically opium poppy stalks (the poppy from which opium is derived).

According to the Court of Appeals’ decision, dated August 4, 2026, the defendant faces a total of ten charges, including three for importing a Schedule A controlled substance, three for possession, and three for possession with intent to distribute, as well as one charge for the use of a Class A controlled substance.

The trial court had ordered his detention until November 2026, finding that the evidence presented before it established a likelihood of conviction and that, given the seriousness of the offenses, there was a risk of flight.

The appellant argued, among other things, that there was insufficient evidence, as the items found—which the police considered to be parts of the opium poppy (poppy), had not yet undergone scientific analysis.

The Court of Appeals, however, ruled that, for the purposes of the pretrial detention proceedings—and not for the final judgment in the case—there was sufficient evidence before the Court to justify the decision to remand the defendant in custody.

As stated in the ruling, the trial court had before it testimony from members of the YKAN, according to which, after opening a package delivered to the appellant, four nylon bags containing dried flower heads were found that “resembled the opium poppy (poppy).” At the same time, a search of his residence uncovered additional quantities of a poppy mixture, which, according to the ruling, he himself admitted in his preliminary testimony that they were opium poppy plants, noting, however, that if he had known they were prohibited in Cyprus, he would not have imported them.

The Court of Appeals noted that “the trial court was entitled, for the purposes of the proceedings before it, and not for the purpose of reaching final conclusions in the main trial, to conclude that there was evidence before it that could lead to a possible conviction.”

With regard to the personal circumstances of the 26-year-old, who is of Asian descent and has been in Cyprus for the past three years or so, the Court of Appeals ruled that they could not take precedence over the public interest.

The Court noted that, although his personal circumstances were taken into account, they were not sufficient to “override the public interest in the administration of justice,” given the seriousness of the charges and the penalties that might be imposed in the event of a conviction.

Consequently, the Court of Appeals dismissed the appeal and upheld the decision to continue his detention until the start of his trial before the Criminal Court.
