European Parliament: Rejects the Commission's Proposal on Tobacco Taxation

The European Parliament’s decision to reject the European Commission’s proposal to revise the Tobacco Taxation Directive (Tobacco Taxation Directive), a development that directly impacts the debate on the future of taxation on tobacco and nicotine products in the European Union.

The decision was made after political groups were unable to reach a mutually acceptable compromise. The proposal drafted by the Committee on Economic and Monetary Affairs (ECON) did not secure the necessary support, while the European Commission’s original proposal was rejected by the plenary with 439 votes against, 181 in favor, and 38 abstentions.

Following the vote, the process continues in the Council of the European Union, where any change to the existing tax regime requires a unanimous decision by the member states.

The debate preceding the vote highlighted the differing approaches among member states regarding the taxation of tobacco and nicotine products.

This is the second time in less than two years that the European Parliament has expressed reservations about the Commission’s initiatives in this area, following previous debates on “Smoke-Free Environments.”

Analysts estimate that the outcome of the vote will be taken seriously into account when drafting future legislative proposals, which will need to seek broader political consensus.

The Green Line, Illegal Crossings, and Tax Policy

For Cyprus, this debate is of particular importance due to the unique circumstances prevailing on the island.

The existence of the Green Line and the ongoing flows of illicit goods from areas not under the effective control of the Republic of Cyprus create additional challenges, which are not encountered to the same extent in other EU Member States.

Any across-the-board or disproportionate tax increases could further widen the price gap and strengthen the incentives for trafficking illicit goods through the occupied areas, with repercussions for jobs, public revenue, the legal market, and public health.

At the same time, such a development would increase the pressure on the relevant regulatory and law enforcement authorities, which are already operating in a particularly challenging environment to combat illicit trade and protect public revenue.

For this reason, it is argued that European tax policies should take into account the specific circumstances of Cyprus, in order to avoid unintended consequences that could further exacerbate illicit product flows.
