Urgent prosecutor’s investigation five years after Mazonakis’ death; potential liability of the Medical Association under scrutiny

Inspections of the private clinic on Karneadou Street and the centers where regenerative therapies are administered

From her private practice on Karneadou Street to the inspections conducted by the Athens Medical Association (ISA) and, more broadly, to all centers where modern regenerative therapies are administered—this is the scope of the urgent prosecutorial investigation ordered today by the head of the Athens First Instance Prosecutor’s Office, Aristides K.

Following the death of singer Giorgos Mazonakis after a plasmapheresis treatment at the clinic on Karneadou Street and the pretrial detention of the two accused doctors, the prosecutor ordered a preliminary investigation. The prosecutor’s investigation will not be limited to the conditions that prevailed at the private clinic on Karneadou Street where the singer suffered cardiac arrest —which, incidentally, is already being investigated by the investigating judge—but will extend to how the relevant authorities exercised their supervisory and oversight roles.

Thus, the focus is, among other things, on whether the required inspections were carried out at that specific clinic, which agencies conducted them, and what their findings were. At the same time, the prosecutor is requesting an investigation into whether the evidence in the case indicates any criminal liability on the part of the Athens Medical Association (ISA) or any other relevant public authority.

Special mention is also made of the use of a plasma removal machine. The prosecutor’s investigation is tasked with examining what actions were taken by the Athens Medical Association (ISA), since, according to the evidence under investigation, this specific method and the related equipment had been presented at conferences as early as 2023.

Investigations Spanning Five Years

The second part of the preliminary investigation is taking on a broader scope, as the probe is being expanded to include all centers where modern regenerative therapies are administered. The head of the prosecutor’s office is seeking to determine whether, over the past five years, the Athens Medical Association (ISA) and other relevant authorities have conducted compliance audits at such facilities, either in response to complaints or on their own initiative.

In this context, the prosecutor is expected to examine whether the competent authorities were aware of the operation of specific centers or of the therapeutic practices applied therein, as well as whether they had taken the necessary inspection or other measures.

At the same time, the prosecutor’s investigation will seek evidence to determine whether there were practices that might have endangered patients’ health or whether there were instances of misleading patients with for the purpose of financial gain.

Thus, the investigation concerns not only what happened at this specific private clinic on Karneadou Street but also the broader context in which facilities providing such therapeutic methods operate.

Prosecutorial authorities are being asked to gather evidence regarding operating licenses, inspections, any complaints, and the actions taken by the relevant authorities, in order to determine whether there were any failures in the oversight mechanism.

At the conclusion of the preliminary investigation, a determination will be made as to whether the totality of the evidence indicates criminal acts and, if so, which individuals or entities are linked to them.
