The reasoning behind the decision by the investigating judge and prosecutor to remand the two doctors—who are accused in the Giorgos Mazonakis case—into custody early this morning is detailed and particularly revealing.
According to reports, in their reasoning for the pretrial detention of Ilias Theodoropoulos and Ioanna Gaka, the investigating judge and prosecutor attribute to them acts and omissions linked to the loss of human life. In fact, the investigating judge and prosecutor, according to the same reports, assessed the conduct of the two defendants as particularly critical after the popular singer’s health deteriorated.

According to the same information, the reasoning behind the pretrial detention order notes that the two doctors performed serious medical procedures in a facility without the required authorization, without the appropriate equipment, and without havingthe patient undergo the necessary tests beforehand.
At the same time, according to the pretrial detention order, the delay in calling the ambulance service was considered a particularly aggravating factor. The doctors allegedly failed to call an ambulance in a timely manner, without providing sufficient justification. This occurred at a time when they themselves were unable to provide Giorgos Mazonakis with the necessary medical assistance to revive him from cardiac arrest.
Another critical point is the defendants’ reaction to the alarms from the hemodialysis machine. Despite the indications which, according to the reasoning, signaled a serious deterioration in the patient’s condition, the medical procedure of plasmapheresis reportedly continued inside the defendants’ clinic on Karneadou Street.
According to the same information, the judicial authorities have concluded that the two defendants were fully aware of the consequences of their actions and omissions. Furthermore, the investigating judge and the prosecutor are reported to have stated that, in this specific case, no other procedural measure is deemed sufficient to prevent the risk of the two doctors committing new criminal actstwo doctors other than their pretrial detention.
At the same time, the reasoning for pretrial detention also refers to actions taken by the two defendants which, in the judgment of the judicial authorities, obstructed the further investigation of the case by concealing evidence.
Earlier, however, the two defendants announced that they would appeal the pretrial detention order in an effort to have it overturned. This development was made public in an official statement by the founder of the law firm “Nikos Agapinos & Associates,” who represents the two defendants.
The defense attorney criticizes the procedural handling of the case, citing an “unjustified” escalation of the charges against his clients and announcing that he will immediately file an appeal against their pretrial detention with the competent Misdemeanor Court.
The law firm’s statement reads as follows: “Following this expected development regarding the procedural treatment of our clients, Ilias Theodoropoulos and Ioanna Gaka, as a result of the completely unjustified escalation of the charges, we will immediately challenge the pretrial detention order before the competent Council, as we believe their procedural rights have been grossly violated.”
It should be noted that the two defendants were taken to prison this morning to face the felony charge of intentional homicide with possible malice committed by omission, following a marathon preliminary hearing that lasted a full 18 hours.
