Penalties for Unsolicited SMS Messages from Parliamentary Candidates, Imposed by the Personal Data Protection Authority

A total of 24 complaints were reviewed

The Personal Data Protection Authority announced that it has completed its review of the complaints filed during the 2026 Election Process for the Election of Members of the House of Representativesand concerned telephone calls and/or SMS messages containing political content or promoting candidates.

During the pre-election period, the Authority received a total of 24 written complaints regarding unsolicited political promotional communications, of which 21 were against political party candidates and 3 against political parties.

As for the subject matter of the complaints, they concerned the receipt of unsolicited phone calls, SMS messages, and emails, and one complaint was also filed regarding the shouting of a name during the election process.

The Authority examined these complaints within the scope of its jurisdiction, and upon completion of the investigation, the following findings emerged:

  • Three complaints were fully investigated, and the administrative sanction of a Warning was imposed.
  • 7 complaints were fully investigated, and Recommendations were duly issued.
  • 14 complaints were deemed unfounded and/or could not be investigated due to the failure to submit the necessary information and/or were withdrawn by the complainants.

It should be noted that the number of complaints filed in connection with the election held on May 24, 2026, was limited compared to the corresponding number of complaints filed duringprevious election processes.
